SYS Nature Life Resort — Terms & Conditions

These Terms and Conditions (“Terms”) apply to reservations, purchases, visits, accommodation, packages, activities, day-out experiences, weddings, events, meeting facilities and other services provided by SYS Nature Life Resort, operated by SYS Investments (Pvt) Ltd, Business Registration No. PV 00275365, of 193/D, Gangabada Road, Kindelpitiya, Welmilla Junction, Bandaragama, Sri Lanka (“SYS Nature Life Resort”, “Resort”, “we”, “us” or “our”).

1. Scope of These Terms #

These Terms apply to bookings and services made or obtained through:

  • the SYS Nature Life Resort website;
  • the Resort’s reservation team;
  • telephone, WhatsApp, email or other direct communication;
  • walk-in reservations;
  • authorised travel agents;
  • online travel agencies;
  • corporate arrangements;
  • wedding and event arrangements; and
  • other authorised sales or reservation channels.

These Terms may apply to:

  • accommodation;
  • multi-room accommodation bookings;
  • accommodation packages;
  • meal and board plans;
  • activities and recreational experiences;
  • optional add-ons;
  • day-out packages;
  • wedding halls and wedding packages;
  • meeting rooms;
  • corporate events;
  • private events;
  • educational programmes;
  • group reservations; and
  • any related Resort service.

Certain services may also be subject to additional booking-specific conditions, quotations, contracts, waivers, safety rules or event agreements.

2. Acceptance of Terms #

By making a reservation, confirming a quotation, making any payment, completing an online booking, checking in, entering the Resort premises or participating in a Resort service or activity, the Guest acknowledges acceptance of the applicable Terms.

Where the website provides a checkbox or similar confirmation stating that the Guest has read and accepted the Terms and Conditions, submitting the booking after providing such confirmation constitutes electronic acceptance of these Terms.

Nothing in these Terms is intended to exclude or restrict rights that cannot lawfully be excluded under applicable Sri Lankan law.

3. Definitions #

For the purpose of these Terms:

“Guest” means any person staying at, visiting or using the facilities or services of the Resort.

“Lead Guest” means the person making a reservation for themselves or on behalf of other persons.

“Booking” means any confirmed reservation for accommodation, packages, facilities, events, activities or other Resort services.

“Accommodation” means any room or accommodation unit offered by the Resort.

“Package” means a combination of accommodation and/or meals, activities, facilities, experiences or other services sold at an agreed package price.

“Board Plan” means a meal arrangement attached to accommodation, including Room Only, Bed & Breakfast, Half Board and Full Board where offered.

“Activity” includes recreational, sporting, farm, nature, educational or other experiences offered or facilitated by the Resort.

“Add-on” means an optional product, activity, meal, service, facility or enhancement added to a Booking.

“Day-Out Package” means a Resort package that does not ordinarily require overnight accommodation unless accommodation is expressly included.

“Event” includes weddings, private functions, corporate events, meetings, conferences, educational events and similar functions.

“Booking Confirmation” means the written or electronic confirmation issued by the Resort after a reservation is accepted.

4. Booking Eligibility #

The person making a Booking must be at least 18 years of age, unless otherwise permitted by applicable law.

The Lead Guest confirms that they are authorised to make the Booking and, where applicable, to accept these Terms on behalf of the persons included in the reservation.

The Lead Guest is responsible for providing accurate information concerning all Guests included in the Booking.

5. Booking Confirmation #

Submitting a booking request does not by itself guarantee availability.

A Booking becomes confirmed when:

  • the Resort accepts the reservation;
  • any required advance payment or deposit has been received or authorised; and
  • a Booking Confirmation has been issued.

The Resort may place a temporary hold on accommodation or facilities while payment is pending. A temporary hold does not constitute a confirmed Booking unless expressly stated.

6. Booking Information #

Guests are responsible for ensuring that information supplied during the booking process is complete and accurate.

This may include:

  • Lead Guest name;
  • contact number;
  • email address;
  • nationality;
  • identification information where required;
  • number of adults;
  • number and ages of children;
  • arrival and departure dates;
  • selected rooms;
  • selected Board Plan;
  • selected package;
  • activities;
  • add-ons;
  • accessibility requirements;
  • dietary requirements; and
  • other information reasonably required to provide the booked service.

The Guest should review the Booking Confirmation immediately and notify the Resort promptly if any information is incorrect.

7. Accommodation Inventory #

The Resort operates multiple accommodation units with different:

  • occupancy capacities;
  • layouts;
  • room features;
  • bedding arrangements;
  • amenities;
  • locations;
  • views; and
  • pricing.

The number, names, configuration and availability of rooms may change over time as the Resort expands, renovates or reorganises its accommodation inventory.

Unless a particular room has expressly been guaranteed, a reservation may be made for a room category rather than an individually numbered accommodation unit.

The Resort may allocate an alternative accommodation unit of an equivalent or higher standard where reasonably necessary due to maintenance, operational requirements or other circumstances.

8. Multi-Room Bookings #

A Guest may reserve more than one room under a single Booking where availability permits.

Each room remains subject to its individual maximum occupancy and safety limits.

Guests must correctly allocate the number of adults and children occupying each room where requested by the booking system or Resort.

The Resort may refuse an occupancy arrangement that exceeds a room’s permitted capacity.

The Lead Guest will normally be treated as the primary contact for the entire multi-room Booking.

Unless otherwise agreed, communications concerning payment, amendments, cancellations and other material changes may be made through the Lead Guest.

Cancellation or amendment of one room within a multi-room Booking may result in:

  • recalculation of package pricing;
  • changes to group discounts;
  • changes to add-on quantities;
  • changes to meal charges;
  • changes to activity charges; or
  • other reasonable adjustments to the remaining Booking.

Any such revised amount should be communicated to the Lead Guest before the amendment is completed.

9. Occupancy #

Each accommodation unit has a maximum permitted occupancy.

The number of persons staying in a room must not exceed the confirmed occupancy unless the Resort gives prior approval.

Unregistered overnight occupants are not permitted.

Additional persons may be subject to:

  • additional-person charges;
  • additional meal charges;
  • extra-bed charges; and
  • applicable taxes or service charges.

The current additional-person charge is LKR 12,000, inclusive of breakfast, unless otherwise stated for a specific Package.

The availability of extra beds, baby cots or similar arrangements is not guaranteed unless confirmed by the Resort.

10. Accommodation Packages #

The Resort may offer accommodation packages including, without limitation:

  • honeymoon packages;
  • romantic stays;
  • BBQ night stays;
  • jungle night stays;
  • candle night stays;
  • seasonal packages;
  • family packages;
  • group packages; and
  • other promotional or experiential packages.

Each Package may include a combination of:

  • accommodation;
  • Board Plans;
  • meals;
  • activities;
  • experiences;
  • decorations;
  • amenities;
  • recreational facilities;
  • special arrangements; and
  • optional Add-ons.

The exact inclusions of a Package will be those stated in the relevant package description, quotation or Booking Confirmation.

11. Package Conditions #

Package components are provided as a bundled offering unless otherwise stated.

A Guest is not automatically entitled to a cash refund, credit or price reduction for voluntarily choosing not to use an included component, subject always to applicable law.

Package components are subject to availability, operational conditions, safety requirements and weather conditions.

Where an included experience cannot reasonably be provided, the Resort may, where appropriate:

  • provide a reasonable substitute;
  • reschedule the experience;
  • provide a credit;
  • adjust the relevant portion of the Booking; or
  • provide another remedy appropriate to the circumstances and applicable law.

Where rooms are automatically allocated as part of a Package, specific rooms are not guaranteed unless expressly stated in the Booking Confirmation.

12. Board and Meal Plans #

Accommodation may be offered with one or more of the following Board Plans:

Room Only – accommodation without meals, unless otherwise stated.

Bed & Breakfast – accommodation and breakfast.

Half Board – accommodation with breakfast and one additional main meal, ordinarily dinner unless otherwise specified.

Full Board – accommodation with breakfast, lunch and dinner.

The exact inclusions shown in the Booking Confirmation will apply.

Meal times, serving locations, buffet arrangements and menus may vary according to occupancy, season, operational requirements and the applicable Package.

Beverages are excluded unless expressly stated as included.

13. Missed Meals #

Guests are encouraged to attend meals during the designated serving period.

Where a Guest voluntarily misses a meal included in a Board Plan or Package, that meal will ordinarily not:

  • be exchanged for cash;
  • be transferred to another date;
  • reduce the room price; or
  • automatically entitle the Guest to a refund.

The Resort may make alternative arrangements at its discretion where reasonable and operationally possible.

This provision does not affect any remedy required under applicable law where the Resort fails to provide a contracted meal.

14. Dietary Requirements and Food Allergies #

Guests should disclose known allergies, food intolerances and significant dietary requirements when making a reservation or as early as reasonably possible before food service.

The Resort will take reasonable precautions once notified.

However, where food is prepared within shared kitchens or preparation areas, the Resort cannot guarantee the absolute absence of traces of particular allergens.

Guests with severe or life-threatening allergies should discuss their requirements directly with Resort management before consuming food provided by the Resort.

15. Activities and Experiences #

Activities offered by the Resort may include recreational, sporting, nature, farm, educational and leisure experiences.

These may include, among other activities:

  • cricket;
  • air-rifle shooting;
  • swimming;
  • cycling;
  • fishing;
  • farm experiences;
  • nature walks;
  • bird watching;
  • fruit harvesting;
  • recreational games;
  • BBQ experiences;
  • campfires; and
  • other seasonal or organised experiences.

The availability of activities may depend on:

  • weather;
  • daylight;
  • staffing;
  • equipment;
  • maintenance;
  • Guest age;
  • Guest capacity;
  • health and safety considerations; and
  • other operational conditions.

16. Activity Safety #

Guests participating in an Activity must comply with:

  • safety instructions;
  • staff directions;
  • posted notices;
  • equipment rules;
  • age restrictions;
  • capacity restrictions; and
  • any Activity-specific requirements.

A Guest must not participate in an Activity where doing so would create an unreasonable safety risk due to intoxication, medical condition, physical inability, unsafe behaviour or failure to follow instructions.

The Resort may stop or refuse participation where reasonably necessary for safety.

Certain higher-risk Activities may require a separate acknowledgement, consent form or waiver.

Parents or guardians remain responsible for the appropriate supervision of children unless a particular supervised programme expressly provides otherwise.

17. Air-Rifle and Similar Controlled Activities #

Any air-rifle shooting or similar controlled Activity may only take place:

  • in an authorised area;
  • during permitted operating times;
  • using approved equipment;
  • under applicable supervision;
  • in accordance with Resort safety procedures; and
  • subject to applicable Sri Lankan law.

Guests must follow all safety instructions immediately.

The Resort may establish minimum-age requirements or require parental/guardian consent for minors.

The Resort may terminate participation immediately where a Guest handles equipment irresponsibly or fails to comply with safety instructions.

18. Optional Add-Ons #

Guests may be able to purchase Add-ons during or after the accommodation booking process.

Add-ons may include:

  • activities;
  • meals;
  • decorations;
  • experiences;
  • transport;
  • additional facilities;
  • equipment;
  • additional persons;
  • special arrangements; or
  • other services.

An Add-on is confirmed only when shown as confirmed in the Booking Confirmation or subsequently confirmed by the Resort.

Where an Add-on is priced per person, per room, per Booking, per session or per unit, the applicable pricing basis will be disclosed during booking or confirmation.

19. Day-Out Packages #

The Resort may offer Day-Out Packages for individuals, families, groups, schools, companies and other organisations.

A Day-Out Package may include:

  • Resort access;
  • meals or refreshments;
  • swimming-pool access;
  • recreational facilities;
  • activities;
  • farm experiences;
  • changing facilities;
  • resting facilities; and
  • other inclusions stated in the applicable Package.

Accommodation is not included unless specifically stated.

20. Day-Out Arrival and Departure #

Day-Out Guests must observe the arrival and departure period stated in their Booking Confirmation.

Current standard Day-Out times, where applicable, are:

Arrival: 9:00 AM
Departure: 5:00 PM

Use of facilities outside the confirmed period requires prior approval and may incur additional charges.

Late arrival does not automatically extend the departure time or entitle the Guest to a reduction in price.

21. Day-Out Guest Numbers #

Day-Out rates may be calculated according to confirmed Guest numbers.

The organiser must provide an accurate final number of adults and children by 12 hours before the event.

Charges for reductions or increases in Guest numbers will be dealt with according to the applicable quotation or Booking Confirmation.

The Resort may refuse additional Guests where capacity, catering or safety limitations prevent their admission.

22. Weddings and Private Events #

The Resort may provide:

  • wedding halls;
  • outdoor wedding locations;
  • receptions;
  • ceremonies;
  • engagement functions;
  • homecoming functions;
  • private celebrations; and
  • other event services.

Wedding and Event reservations may be subject to a separate Wedding/Event Agreement, quotation or function sheet.

Where a separate agreement exists, that agreement will apply together with these Terms.

If there is a direct inconsistency, the more specific written term agreed for the Event will ordinarily apply to that Event, subject to applicable law.

23. Event Venue Capacity #

Each wedding hall, meeting room and event location has a maximum permitted capacity.

The organiser must not exceed the confirmed venue capacity.

The Resort may refuse additional attendees where necessary for:

  • safety;
  • licensing;
  • fire regulations;
  • seating arrangements;
  • catering;
  • parking;
  • operational capacity; or
  • Guest comfort.

24. Event Deposits and Payments #

Wedding and Event reservations may require:

  • a reservation deposit;
  • staged payments;
  • a final balance;
  • a refundable security deposit; and/or
  • payment for additional services.

The applicable amounts and deadlines will be specified in the Event quotation or agreement.

Unless otherwise agreed, a tentative Event date will not be regarded as finally confirmed until the required deposit has been received.

25. Event Guest Count #

The organiser must provide the Resort with a final expected attendance by one day before the Event.

The final invoice may be based on:

  • the guaranteed Guest count;
  • the actual attendance;
  • the agreed minimum attendance; or
  • another basis stated in the Event Agreement.

The applicable method must be specified before final confirmation of the Event.

26. Event Duration and Overtime #

Events must commence and conclude within the agreed time.

Additional use of the venue beyond the contracted period is subject to availability and may incur overtime charges.

The Resort may require music, entertainment or other activities to end at a particular time to comply with legal, licensing, environmental or operational requirements.

27. Event Decorations and External Suppliers #

External decorators, florists, photographers, videographers, entertainers, DJs, technical suppliers and other vendors require prior approval where required by the Resort.

Suppliers must comply with:

  • venue rules;
  • access schedules;
  • health and safety requirements;
  • electrical requirements;
  • fire-safety requirements;
  • noise restrictions; and
  • instructions issued by Resort management.

No fixture, decoration or installation may damage Resort property.

The organiser may be responsible for loss or damage attributable to suppliers appointed by the organiser to the extent permitted by law.

28. Fireworks, Open Flames and Special Effects #

Fireworks, pyrotechnics, open flames, smoke effects, confetti cannons and similar items may not be used without prior written approval from the Resort and any approval required by law.

The Resort may prohibit a proposed effect where it reasonably considers it unsafe, environmentally inappropriate or likely to cause property damage.

29. Outdoor Events and Weather #

Outdoor weddings, ceremonies, dining arrangements and other events are subject to weather and environmental conditions.

The Resort cannot guarantee weather conditions.

Where practicable, the Resort and organiser may agree on a weather contingency plan.

Moving an Event indoors or modifying arrangements because of adverse weather does not automatically create a right to cancel the entire Event without charge.

Any refund, rescheduling or alternative arrangement will depend on the agreed Event terms, circumstances and applicable law.

30. Meeting Rooms and Corporate Events #

Meeting rooms may be reserved for:

  • corporate meetings;
  • workshops;
  • training;
  • conferences;
  • seminars;
  • presentations;
  • educational programmes; and
  • private business events.

The Booking Confirmation should state the applicable:

  • room;
  • date;
  • time;
  • capacity;
  • seating arrangement;
  • food and beverage requirements;
  • equipment;
  • internet requirements;
  • additional services; and
  • price.

31. Meeting Equipment #

Audio-visual equipment, projectors, screens, microphones, internet services and other technical equipment are subject to availability.

Where equipment is included, Guests must use it responsibly.

Guests may bring external equipment with prior approval.

The Resort is not responsible for incompatibility between Guest equipment and Resort systems unless compatibility was expressly guaranteed.

Guests should maintain appropriate backup copies of business presentations and other important digital material.

32. Rates and Pricing #

Prices applicable to a Booking will ordinarily be those displayed or communicated when the Booking is confirmed.

Prices may vary according to:

  • accommodation category;
  • number of Guests;
  • dates;
  • season;
  • demand;
  • Board Plan;
  • Package;
  • duration;
  • activities;
  • Add-ons;
  • promotions; and
  • booking channel.

The Resort may change prices for future unconfirmed reservations at any time.

A change in publicly displayed pricing after a Booking has been confirmed will not ordinarily alter the confirmed price unless the Booking itself is subsequently modified or there has been an obvious pricing error, subject to applicable law.

33. Taxes and Service Charges #

Applicable government taxes, levies, service charges and other mandatory charges will be included or added as disclosed during the reservation process, quotation or Booking Confirmation.

Where a government tax or mandatory statutory charge changes after booking but before the service is supplied, the Resort may apply the legally required adjustment where permitted by law.

34. Currency #

The Resort may display pricing in Sri Lankan Rupees (LKR), United States Dollars (USD) or other supported currencies.

The Resort’s principal settlement currency will be LKR, unless otherwise stated.

Foreign-currency amounts shown on the website may be approximate conversions.

Where a Guest’s bank or card issuer performs currency conversion, its own exchange rate and fees may apply.

The Resort is not responsible for exchange-rate differences or charges imposed independently by banks, payment networks or card issuers.

35. Payment Methods #

The Resort may accept payment through:

  • cash;
  • bank transfer;
  • debit card;
  • credit card;
  • approved online payment gateways; and
  • other payment methods expressly accepted by the Resort.

Payment is considered received when successfully credited or confirmed through the relevant payment channel.

36. Advance Payments and Deposits #

Certain Booking types may require advance payment.

The required amount will be displayed or communicated before confirmation.

Different deposit requirements may apply to:

  • ordinary accommodation;
  • accommodation Packages;
  • Day-Out Packages;
  • Weddings;
  • Events;
  • meeting rooms; and
  • group Bookings.

The Resort may cancel an unconfirmed reservation if the required payment is not received by the stated deadline.

37. Security Deposits #

The Resort may require a refundable security or damage deposit for selected Bookings, activities, events or group reservations.

The deposit may be applied against:

  • unpaid charges;
  • missing Resort property;
  • repair of damage attributable to the Guest;
  • excessive cleaning reasonably required because of Guest conduct; or
  • other amounts properly payable under the Booking.

Any remaining balance will be returned within 7 business days, subject to payment-processing times.

38. Cancellations #

Cancellation conditions may differ according to:

  • room rate;
  • Package;
  • promotion;
  • booking channel;
  • group Booking;
  • Day-Out Package;
  • Wedding;
  • Event; or
  • meeting room.

The applicable cancellation conditions should be disclosed before the Guest confirms the Booking.

The Resort’s standard accommodation cancellation policy is:

Cancellation more than 14 days before arrival: Full refund

Cancellation between 7 and 14 days before arrival: 50% of the Booking value will be charged

Cancellation within 7 days of arrival: Booking becomes non-refundable

Where a Booking Confirmation contains a specifically agreed cancellation policy, that policy will apply to that Booking subject to applicable law.

39. Non-Refundable Bookings #

Certain promotional rates or Packages may be identified as Non-Refundable.

Where a Guest voluntarily cancels such a Booking, amounts paid may be non-refundable in accordance with the conditions disclosed before purchase, subject to rights that cannot legally be excluded.

40. Booking Amendments #

Changes to:

  • dates;
  • room type;
  • Guest numbers;
  • room quantity;
  • Board Plan;
  • Packages;
  • activities;
  • Add-ons; or
  • other Booking components

are subject to availability.

An amendment may result in a revised price.

The Resort should communicate any additional amount before completing a material amendment requested by the Guest.

41. Partial Cancellation of Multi-Room Bookings #

A Guest may request cancellation of one or more rooms within a multi-room reservation.

Any refund or adjustment will depend upon:

  • the cancellation policy;
  • the cancelled room rate;
  • remaining room quantities;
  • Package conditions;
  • promotions;
  • revised Guest numbers;
  • Board Plans;
  • activities; and
  • Add-ons.

Where a group or multi-room discount depended upon a minimum quantity, cancelling part of the reservation may cause the remaining reservation to be recalculated at the applicable rate.

42. No-Shows #

A Guest who fails to arrive on the confirmed arrival date without notifying the Resort may be treated as a no-show.

The applicable no-show charge is that the Booking becomes non-refundable.

The Resort may release the accommodation 12 hours after the scheduled check-in time on the arrival date where the Guest has not arrived and has not contacted the Resort.

43. Early Departure #

Where a Guest voluntarily leaves before the confirmed departure date, the unused accommodation nights are non-refundable.

This is separate from, and does not affect, the standard cancellation conditions that apply before arrival.

44. Refunds #

Where a refund is approved or legally required, the Resort will ordinarily return the amount using the original payment method where reasonably possible.

Approved refunds will normally be initiated within 7 business days after approval, excluding additional processing time imposed by banks or payment providers.

Any deduction for payment-processing costs will be made only where legally permitted and appropriately disclosed.

45. Check-In #

Standard accommodation check-in time is: 1:00 PM

Early check-in between 6:00 AM and 12:00 PM is subject to availability and, where granted, is charged at 50% of the applicable nightly room rate.

All persons staying overnight must be properly registered where required.

46. Check-Out #

Standard accommodation check-out time is: 11:00 AM

Late check-out until 6:00 PM requires prior approval, is subject to availability and, where granted, is charged at 50% of the applicable nightly room rate.

Guests should settle all outstanding charges before departure.

47. Identification #

Guests may be required to provide a valid:

  • National Identity Card;
  • passport; or
  • other legally acceptable identification.

The Resort may record legally required Guest information for registration, security and regulatory purposes.

Foreign nationals may be required to provide passport and immigration-related information where required by applicable law.

48. Children and Minors #

Children are welcome subject to applicable room capacity, package and safety conditions.

The Resort’s age categories are:

Infant: 0 to 3 years
Child: 4 to 12 years
Adult pricing from: 13 years

The applicable child pricing will be communicated before booking.

Children must remain appropriately supervised by their parent, guardian or responsible adult.

Particular supervision is required around:

  • swimming pools;
  • lakes;
  • water features;
  • roads and parking areas;
  • balconies;
  • stairs;
  • outdoor activity areas;
  • farm areas;
  • animals;
  • cycling areas; and
  • controlled sporting activities.

49. Visitors #

Only registered Guests may stay overnight in Resort accommodation.

Visitors may be permitted according to Resort policy, opening hours and capacity.

Visitors may be required to:

  • register;
  • provide identification;
  • pay applicable visitor or facility charges; and
  • leave by a specified time.

The registered Guest must take reasonable responsibility for the conduct of persons invited by them.

50. Guest Conduct #

Guests must behave in a manner that respects:

  • other Guests;
  • employees;
  • suppliers;
  • local communities;
  • wildlife;
  • Resort property; and
  • the natural environment.

The Resort does not permit:

  • violence;
  • threats;
  • harassment;
  • abusive conduct;
  • deliberate property damage;
  • serious disturbance;
  • dangerous conduct;
  • illegal activity; or
  • conduct materially interfering with Resort operations.

The Resort may take reasonable action necessary to protect Guests, staff and property.

51. Quiet Hours #

The Resort provides a nature-focused environment and Guests must keep noise at a reasonable level.

Quiet hours are:

9:00 PM to 6:00 AM

Approved Weddings or Events may operate according to separately agreed schedules.

52. Smoking and Vaping #

Smoking and vaping are prohibited inside accommodation and designated non-smoking areas.

Smoking is permitted only in designated areas where allowed by law.

Reasonable cleaning or repair charges may apply where smoking causes damage or exceptional cleaning requirements.

53. Alcohol #

Alcohol may only be supplied, sold, brought onto or consumed at the Resort in accordance with applicable Sri Lankan law, licensing requirements and Resort policy.

Event organisers should obtain confirmation regarding:

  • alcohol service;
  • outside beverages;
  • corkage;
  • bar closing time; and
  • related charges

before confirming an Event.

Outside alcohol brought onto the premises is subject to a one-time corkage fee of LKR 5,000 (not charged per bottle).

The Resort may refuse alcohol service where required by law or where continued service would create a safety risk.

54. Illegal Substances and Prohibited Items #

Illegal drugs and unlawful substances are prohibited.

Guests may not bring unlawful weapons, explosives or dangerous materials onto Resort premises.

Any permitted possession or use of controlled items remains subject to applicable law and Resort safety requirements.

55. Outside Food, Beverages and Pets #

Outside food is not permitted on Resort premises.

Exceptions may be considered for:

  • infant food;
  • medically necessary food;
  • speciality wedding items; or
  • other arrangements approved in advance.

Applicable outside-food, beverage or corkage charges must be communicated where relevant.

Pets are not permitted on Resort premises.

56. Swimming Pool #

Guests using the swimming pool must comply with displayed safety rules and staff directions.

Children must be appropriately supervised.

Guests should not use the pool while:

  • intoxicated;
  • seriously unwell;
  • behaving dangerously; or
  • otherwise unable to use the facility safely.

57. Natural and Farm Environment #

SYS Nature Life Resort includes natural and outdoor environments.

Guests may encounter:

  • uneven ground;
  • wet surfaces;
  • mud;
  • insects;
  • reptiles;
  • birds;
  • wildlife;
  • agricultural areas;
  • plants;
  • falling branches or fruit;
  • changing weather; and
  • other characteristics of a tropical environment.

Guests should take reasonable precautions, wear suitable footwear where appropriate and follow staff instructions.

Guests must not deliberately harm, capture, remove or disturb wildlife or plants except as part of an authorised Resort Activity.

58. Medical Conditions #

Guests should consider their own health and physical ability before participating in activities.

A Guest should notify the Resort in advance where a medical condition, mobility limitation or other circumstance materially affects their ability to safely participate in a booked Activity.

The Resort does not provide medical diagnosis or professional medical treatment.

Any first-aid assistance provided is intended only as immediate assistance pending professional care where necessary.

59. Accessibility #

Guests requiring accessibility arrangements are encouraged to contact the Resort before booking.

The Resort will provide accurate information regarding available facilities and will consider reasonable arrangements where practicable.

Specific accessible facilities should not be assumed unless confirmed.

60. Damage to Property #

Guests must take reasonable care of Resort rooms, facilities, equipment and property.

A Guest may be responsible for the reasonable cost of repairing or replacing damage caused through deliberate action, misuse or negligence by that Guest or persons for whom the Guest is legally responsible.

Normal wear and tear will not be charged.

61. Personal Belongings #

Guests should take reasonable precautions to secure personal belongings.

Where safes or secure storage facilities are provided, Guests are encouraged to use them for valuables.

Nothing in these Terms excludes liability that cannot legally be excluded.

62. Lost Property #

Property found after departure may be retained for 30 days.

The Resort will take reasonable steps to identify the owner where practicable.

The Guest may be responsible for courier or delivery charges associated with returning lost property.

Items remaining unclaimed after the applicable retention period may be disposed of, donated or otherwise handled as appropriate and lawful.

63. Vehicles and Parking #

Parking may be provided subject to availability.

Guests must follow Resort traffic and parking instructions.

Vehicles must not obstruct:

  • access roads;
  • emergency routes;
  • entrances;
  • landscaped areas; or
  • operational zones.

Guests remain responsible for appropriately securing their vehicle and belongings.

64. Room Access #

The Resort respects Guest privacy.

Authorised staff may nevertheless enter accommodation where reasonably necessary for:

  • housekeeping;
  • maintenance;
  • repairs;
  • emergencies;
  • security;
  • Guest welfare;
  • investigation of significant damage; or
  • investigation of a serious breach of Resort rules.

Except in emergencies, reasonable regard will be given to Guest privacy.

65. Wi-Fi and Internet #

Where internet services are offered, continuous availability or speed cannot be guaranteed.

Guests must not use the Resort network for:

  • unlawful activity;
  • unauthorised system access;
  • distribution of malicious software; or
  • activity that may compromise network security.

66. Photography and Videography #

Personal photography and video are generally permitted where they do not materially interfere with other Guests’ privacy or Resort operations.

Commercial photography, commercial filming, organised photo shoots and professional productions require prior Resort approval.

Additional charges may apply.

67. Drones #

Drone use requires prior written Resort approval.

Any drone operation must comply with:

  • applicable aviation requirements;
  • privacy requirements;
  • safety requirements; and
  • instructions issued by Resort management.

Approval may be refused because of weather, Guest privacy, wildlife, Events or safety considerations.

68. Photography by the Resort #

The Resort will not treat acceptance of these general Terms alone as blanket permission to commercially advertise an identifiable Guest using that Guest’s image.

Where consent is legally required for promotional photography or filming, separate appropriate permission should be obtained.

69. Third-Party Services #

The Resort may arrange or facilitate services supplied by independent third parties, such as:

  • transport;
  • guides;
  • entertainment;
  • external vendors;
  • equipment suppliers; or
  • activity operators.

Where the Resort acts only as an intermediary, the independent provider remains responsible for performing its service.

Nothing in this provision excludes responsibility the Resort may have for its own acts or omissions.

70. Third-Party Booking Platforms #

Bookings may be accepted through authorised online travel agencies or travel partners.

Where a Guest books through a third-party platform:

  • that platform’s booking terms may also apply;
  • payment may be collected by the platform;
  • amendments may need to be requested through the platform; and
  • refunds may be processed according to the payment arrangement established through that platform.

Booking-specific conditions displayed and accepted through an authorised third-party channel will apply to that reservation where appropriate.

71. Website Information #

The Resort takes reasonable measures to maintain accurate website information.

However, minor differences may occur due to:

  • renovations;
  • maintenance;
  • seasonal landscape changes;
  • furniture replacement;
  • weather;
  • natural conditions; and
  • operational improvements.

Website photographs are intended to reasonably represent the facilities but do not guarantee identical natural conditions, room views, vegetation or decorative arrangements at all times.

72. Obvious Errors #

Where a genuine technical, typographical or pricing error occurs, the Resort may contact the Guest promptly after discovery.

The Resort and Guest may agree to:

  • correct the Booking;
  • accept the proper price;
  • select an alternative; or
  • cancel and refund affected amounts where appropriate.

This provision will be applied subject to applicable consumer law.

73. Maintenance and Facility Closures #

Facilities may occasionally be unavailable because of:

  • maintenance;
  • repairs;
  • safety inspections;
  • weather;
  • operational requirements; or
  • circumstances outside reasonable control.

The Resort will take reasonable steps to minimise significant disruption.

Where a material contracted service cannot be supplied, an appropriate solution will be considered based on the circumstances and applicable law.

74. Events Beyond Reasonable Control #

The Resort will not be responsible for failure or delay caused solely by circumstances genuinely outside its reasonable control, subject to applicable law.

Such circumstances may include:

  • severe weather;
  • flooding;
  • natural disasters;
  • epidemics or public-health restrictions;
  • government action;
  • civil disturbance;
  • interruption of essential public infrastructure;
  • major utility failure; or
  • comparable events.

Where such circumstances materially affect a Booking, the Resort will communicate with the Guest and consider reasonable options including rescheduling, credit, alternative arrangements or refunds as appropriate to the particular circumstances and applicable law.

75. Cancellation or Change by the Resort #

In exceptional circumstances, the Resort may need to cancel or materially change a Booking.

Where the Resort is responsible for being unable to provide the confirmed service, it may offer, as appropriate:

  • equivalent or upgraded accommodation;
  • alternative dates;
  • an alternative facility;
  • a reasonable substitute service; or
  • a refund for services that cannot be supplied.

Any statutory rights remain unaffected.

76. Personal Data and Privacy #

The Resort may collect and process personal information necessary to:

  • process Bookings;
  • provide accommodation and services;
  • communicate with Guests;
  • process payments;
  • fulfil legal requirements;
  • manage safety and security;
  • administer Events;
  • respond to enquiries and complaints;
  • prevent fraud; and
  • conduct permitted marketing activities.

Information may include:

  • names;
  • contact information;
  • identification information;
  • nationality;
  • Booking history;
  • Guest preferences;
  • payment-related information;
  • Event information; and
  • other information reasonably required for Resort operations.

Personal information will be handled in accordance with applicable Sri Lankan data-protection requirements and the Resort’s separate Privacy Policy or Privacy Notice.

77. Payment Information #

Where online payments are processed through an authorised payment provider, payment-card details may be processed by that provider according to its security and privacy arrangements.

The Resort will not request Guests to disclose card PINs, online banking passwords or similar confidential authentication credentials.

78. CCTV and Security #

CCTV may operate in selected public and security-sensitive locations for legitimate security, safety and property-protection purposes.

CCTV will not be installed in guest rooms, bathrooms or similar private areas.

Recordings will be managed according to applicable legal and privacy requirements.

79. Marketing Communications #

The Resort may send promotional communications where it has an appropriate legal basis to do so.

Guests may opt out of promotional communications through the method provided by the Resort.

Operational communications concerning an existing Booking may still be sent where necessary.

80. Limitation of Liability #

Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted.

Subject to applicable law, the Resort will not be responsible for loss arising solely because of:

  • circumstances outside its reasonable control;
  • failure by the Guest to follow reasonable safety instructions;
  • unlawful or reckless behaviour by the Guest;
  • undisclosed medical or safety information materially affecting an Activity; or
  • independent acts of third parties for whom the Resort is not legally responsible.

Any limitation contained in these Terms applies only to the extent permitted under Sri Lankan law.

81. Right to Refuse or Terminate Service #

Subject to applicable law, the Resort may refuse entry, participation or continued accommodation where reasonably necessary because of:

  • serious misconduct;
  • violence;
  • threats;
  • harassment;
  • significant danger;
  • deliberate damage;
  • serious unlawful activity;
  • fraud;
  • materially false booking information;
  • failure to make payments properly due;
  • serious or repeated breaches of Resort rules; or
  • lawful directions issued by authorities.

Any refund or financial consequence will depend on the reason, applicable Booking conditions and applicable law.

82. Complaints #

Guests are encouraged to notify Resort management promptly of any problem so the Resort has a reasonable opportunity to investigate and resolve it during the stay or Event.

The Resort will endeavour to acknowledge and respond to written complaints within 2 business days.

Nothing prevents a Guest from exercising rights available through an appropriate regulatory authority, consumer-protection body or court.

83. Intellectual Property #

Unless otherwise stated, the Resort’s:

  • name;
  • logo;
  • branding;
  • website;
  • photographs;
  • graphics;
  • written content; and
  • original promotional materials

are owned by or licensed to the Resort.

They may not be reproduced for commercial purposes without permission.

This provision does not prevent Guests from taking ordinary personal photographs subject to these Terms.

84. Booking-Specific Terms #

A Booking Confirmation, quotation, Package description, Event Agreement or promotion may contain additional conditions.

Those conditions form part of the agreement for that Booking.

Where a specific commercial term agreed for a particular Booking differs from a general provision in these Terms, the specific agreed term will ordinarily apply to that matter, subject to applicable law.

85. Entire Booking Agreement #

The agreement for a particular reservation may consist of:

  • these Terms and Conditions;
  • the Booking Confirmation;
  • the selected Package or rate conditions;
  • any applicable quotation;
  • any separate Wedding/Event/Meeting Agreement;
  • any relevant activity-specific terms; and
  • the Resort Privacy Policy or Privacy Notice where applicable.

86. Consumer Rights #

These Terms are intended to operate consistently with applicable Sri Lankan consumer-protection legislation.

Nothing contained in these Terms is intended to remove, waive or reduce a statutory consumer right that cannot legally be excluded.

87. Governing Law #

These Terms and the contractual relationship between the Resort and the Guest are governed by the laws of the Democratic Socialist Republic of Sri Lanka.

Subject to any applicable statutory dispute-resolution rights, disputes will be subject to the jurisdiction of the competent courts of Sri Lanka.

88. Severability #

If a court or competent authority determines that any provision is invalid, unlawful or unenforceable, the affected provision will be limited or interpreted to the minimum extent necessary where legally possible.

The remaining provisions will continue to apply.

89. No Waiver #

Failure by the Resort to enforce a provision on one occasion does not automatically waive its right to enforce that provision subsequently.

90. Changes to These Terms #

The Resort may update these Terms for future Bookings to reflect:

  • legal changes;
  • regulatory requirements;
  • operational changes;
  • new facilities;
  • new services; or
  • changes to Resort policies.

The version applicable to an existing confirmed Booking will ordinarily be the version made available when that Booking was made, except where a change is required by law or mutually agreed.
